The State appeals the trial courts order granting appellee Sean Eric Seiberts motion to quash and dismissing the indictment. In two issues, the State argues the trial court erred in (1) testing the States evidence at trial in its reconsideration and granting of appellees motion to quash and (2) dismissing a facially valid indictment for the offense of stalking. For the reasons that follow, we resolve the first issue against the State and the second issue in its favor. Accordingly, we reverse and remand.
